Terms of Use
Effective October 1, 2026
The short version
- Pathfynder helps drivers and passengers find each other. We don't provide rides, employ drivers or own vehicles.
- Rides are cost-sharing carpools between people, paid in the car. You decide who you ride with.
- Drivers are responsible for their licence, insurance and vehicle.
- Be honest, be respectful, and don't misuse the Service.
1. Agreement
These Terms are an agreement between you and Pathfynder Car Pool Inc. ("Pathfynder", "we", "us"). They apply to pathfynder.ca, the Explore page, the Pathy WhatsApp bot, our Telegram bot, and related pages (the "Service"). By using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
2. What Pathfynder is (and isn't)
Pathfynder is a coordination tool. We collect and organize ride posts so drivers and passengers heading the same way can find and contact each other.
- We are not a transportation company, taxi, or rideshare operator, and drivers are not our employees or contractors.
- We don't check drivers' licences, insurance, vehicles or backgrounds, and we don't check passengers.
- Some listings come from public sources such as WhatsApp groups, Facebook groups and Poparide. We don't control those posts and can't confirm they're accurate or still available.
- Any arrangement for a ride is made directly between the driver and passenger.
3. Who can use it
You must be at least 18 and able to enter a binding agreement. Our rides focus on Ontario and other parts of Canada.
4. If you're a driver
- You must hold a valid driver's licence, and your vehicle must be legally registered, safe and properly insured.
- You're responsible for making sure your insurance covers carrying passengers. Many personal policies only cover carpooling where the driver shares costs and doesn't make a profit.
- Fares should only cover your share of trip costs (such as gas and wear). Don't use Pathfynder to run a commercial taxi or ride-hailing business.
- Follow all traffic laws, and never drive impaired.
- Post accurate routes, times, seats and fares, and update or cancel rides that change.
5. If you're a passenger
- Confirm the ride details directly with the driver before you travel.
- Show up on time, wear a seatbelt, and treat the driver and vehicle with respect.
- Pay the agreed amount in the car, unless you and the driver agree otherwise.
6. Safety
You're responsible for your own safety decisions. We suggest meeting in public places, sharing your trip with someone you trust, and checking the driver's name and vehicle before getting in. In an emergency, call 911.
7. Payments and fees
Pathfynder doesn't handle payments between riders and isn't responsible for missed payments, refunds or disputes. Using the Service is currently free. We may introduce fees (for example, a driver fee) in the future; we'll tell you before they apply, and you can choose not to continue.
8. Your content
When you post a ride or message Pathy, you allow us to store, display and share it within the Service to help people find rides. You confirm the information is yours to share and is accurate. We may edit, hide or remove any listing at any time.
9. What's not allowed
- Fake, misleading or spam ride posts, or posting on someone else's behalf without permission.
- Harassing, threatening or discriminating against anyone.
- Collecting other users' contact details for marketing, resale or anything outside arranging a ride.
- Scraping, overloading, hacking or trying to get around security on the Service.
- Using the Service for anything illegal, including carrying illegal goods.
We may suspend or block anyone who breaks these rules.
10. Third-party services
The Service works with WhatsApp, Telegram, maps and other third-party services. Their own terms apply, and we're not responsible for them or for outside websites we link to.
11. Disclaimers
The Service is provided "as is" and "as available." To the extent the law allows, we make no promises that it will be accurate, uninterrupted or error-free, or that any ride, driver or passenger will be available, safe or suitable.
12. Limitation of liability
To the extent the law allows, Pathfynder and its owners aren't liable for any injury, loss, damage, delay, theft, or dispute arising from a ride or from contact between users, or for any indirect or consequential losses. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the past 12 months or CAD $100.
Nothing in these Terms limits rights you have under Ontario consumer protection law that can't be waived.
13. Indemnity
You agree to cover Pathfynder for claims and costs that result from your use of the Service, your rides, or your breaking these Terms or the law.
14. Ending use
You can stop using the Service at any time and ask us to remove your information. We can suspend or end access at any time, especially for misuse. Sections that by nature should continue (like 11 to 15) still apply after that.
15. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be handled in the courts of Ontario.
16. Changes
We may update these Terms. We'll change the date at the top and, for important changes, let you know on the site or through the bot. Continuing to use the Service means you accept the new Terms.
